Legal Action Moving Forward on More Delinquent Solid Waste Disposal Fee Accounts

Legal action will soon commence against additional delinquent residential and commercial solid waste disposal fee account holders in Lawrence County.

More than 6,000 letters are currently being issued to residential and commercial account holders with delinquent solid waste disposal fees for the years 2001 through 2006.  These letters will notify delinquent account holders of their total delinquency amounts as well as the year or years past due. 

According to County Attorney Charlie Holt, these letters will offer one final opportunity to pay delinquent fees before additional fines are assessed as part of the legal process.

Fees which are not paid by April 30, 2008 will be subject to legal action through the Circuit Court of Lawrence County. Once the suits have been filed, the names of delinquent account holders will become public record and will be posted on the county’s web page.

According to Lawrence County Executive Paul Rosson, the pending action against delinquent solid waste account holders is an issue of fundamental fairness. “Our office has worked very hard to this point to collect these fees in the usual manner,” Rosson said. “It has, however, become necessary to file legal action against those who have chosen not to pay this fee.”

Holt said lawsuits will be filed against those who do not pay their accounts in full or make payment arrangements by the end of April. Residents or businesses which receive letters regarding delinquent accounts should contact the Office of Accounts and Budgets at 766-1581 extension 109 or 110 to make payment arrangements.    

Legal action has already commenced in Circuit Court for holders of delinquent solid waste disposal fee accounts for the year 2000.
